Terms of Service

1. Agreement
By creating an account and using DownUnder WP (“Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is provided by DownUnder Web Services, an Australian-owned and operated hosting platform.
2. Service Description
DownUnder WP provides managed WordPress hosting on Australian infrastructure. Each site runs in its own isolated container with automated SSL, managed deployment, and Australian data residency. Service availability targets 99.5% uptime but is not guaranteed.
3. Billing & Payment
Subscriptions are billed in Australian Dollars (AUD) via Stripe, monthly or annually depending on the plan you choose at signup. Your subscription renews automatically at the end of each billing period. If payment fails, your account will be suspended until payment is resolved. No refunds are provided for partial billing periods. You may cancel at any time from your billing dashboard.
4. Plan Limits
Single Site plan: 1 WordPress site, 2 GB storage. Multisite plan: 1 WordPress Multisite installation with 3 subsites included, expandable via add-on, 5 GB storage. Current pricing for plans and add-ons is shown on our website and in your dashboard. Exceeding plan limits may result in throttling or suspension.
5. Acceptable Use
You must comply with our Acceptable Use Policy. Prohibited uses include spam, malware distribution, illegal content, cryptocurrency mining, and excessive resource consumption. Violations may result in immediate suspension.
5a. Fair Use & Right to Refuse Service
DownUnder WP is a low-cost, shared-infrastructure hosting platform built to keep WordPress hosting affordable for Australian small businesses, community organisations, and individuals. To keep prices low for everyone, we operate on a fair-use basis.
We reserve the right to throttle, refuse, suspend, or terminate service to any account whose resource consumption (CPU, memory, bandwidth, request volume, storage, or otherwise) is consistently disproportionate to the cost of the plan they are paying for. This includes, but is not limited to, sites running heavy automated traffic, scraping, large-scale email sending, video encoding, AI model serving, or other workloads not typical of a small WordPress website.
Where reasonable, we will contact you first and offer an upgrade path or migration option before taking action. Where the impact on other customers is immediate, we may act first and contact you afterwards. Repeat or wilful resource abuse is grounds for immediate termination without refund.
We also reserve the right to refuse service at our discretion to any account where we have reason to believe continued service would harm the platform, our customers, or third parties.
6. Data & Backups
You are responsible for your own data and your own backups. DownUnder WP does not provide automatic backups as part of the standard service. If your site is hacked, deleted, corrupted, or otherwise lost, we are not obliged to recover it.
We strongly recommend you take one of the following steps before relying on the platform for any production site:
- Subscribe to our Daily Backups add-on, which takes a daily snapshot of your full WordPress files and database, retains it for 7 days, and provides self-service download and restore from your dashboard. Pricing is shown on the add-ons page in your dashboard.
- Periodically export your WordPress content yourself using the data tools in your dashboard and keep copies offsite.
We do not guarantee complete backup integrity or successful recovery under any circumstance. Use the add-on or your own export routine - or both.
7. Termination
Either party may terminate the service at any time. Upon cancellation, your account remains active until the end of the current billing period, then enters a 7-day grace period during which you may still export your data. After the grace period, your containers, databases, and all associated data are permanently deleted and cannot be recovered. We reserve the right to suspend or terminate accounts that violate these terms, immediately and without notice.
8. Limitation of Liability
To the extent permitted by Australian law, DownUnder WP is not liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability is limited to the amount paid in the three months preceding the claim.
9. Governing Law
These terms are governed by the laws of Queensland, Australia. Disputes shall be resolved in the courts of Queensland.
10. Changes
We may update these terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify active customers of material changes via email.
